Objection and appeal

If you disagree with a decision, you have the legal right to object.

You can file an objection by submitting an objection letter. The objection letter must be submitted within six weeks of receiving the letter containing the decision. Fijnder Please note that this deadline is very important. So make sure you submit your objection on time. 

How do you file an objection?

Digital

By post

You can send an objection by mail to: P.O. Box 109, 7140 AC, Groenlo. It is important to include the following information in your objection:

  • Your name and address.
  • The date of the letter containing the decision.
  • Which decision you disagree with. Please specify the date or reference and the subject.
  • Why you disagree with the decision.
  • Your signature.

What happens if you have filed an objection?

After submitting your objection, you will receive a confirmation of receipt. You will also receive an invitation to a hearing later. An independent committee will conduct the hearing. You can choose whether or not to attend. The invitation to the hearing also includes the case file, which contains all the information you need for the hearing.

Hearing

The hearing is not public. A report will be made of the hearing. During a hearing, committee members may ask questions of you or a staff member of FijnderThe committee does this if not everything is clear. An employee of Fijnder also tells why Fijnder has made a certain decision.

I'm coming to the hearing

During the hearing, you can explain why you disagree with the decision. You can do this yourself, or you can have someone else do it. In that case, make sure you've given the other person (written) permission to speak on your behalf. If you're bringing a lawyer to the hearing, you don't need to give your lawyer permission.

I will not come to the hearing

Attending the hearing is not mandatory. If you don't attend, your objection will be processed based on the information available at that time. 

I can't come to the hearing

If you received an invitation to a hearing and are unable to attend, you can ask the committee secretariat to reschedule the hearing. The secretariat may inquire as to why you are unable to attend. You can contact the secretariat via: info@fijnder.nl of 0544 - 47 42 00

When will you receive a decision?

If a hearing has taken place, the committee members will discuss the objection. Sometimes the committee needs additional information from FijnderIf the committee does not require any additional information, they will provide written advice to the board of FijnderThe board of Fijnder will then make a decision on the objection. You will receive the decision on your objection within twelve weeks of submitting it. If a decision cannot be made within twelve weeks, the committee will notify you. The board of Fijnder can make various decisions:

  • Your objection has been upheld, either wholly or partially. This means you are fully or partially in the right.
  • Your objection has been declared unfounded. This means the board disagrees with your objection. No other decision will be made.
  • Your objection has been declared inadmissible. This means it will not be processed. This can happen if you submitted your objection too late or because you didn't specify which decision you disagree with.

(Higher) Appeal

Have you gone through an objection procedure and disagree with the decision? Then you can appeal. To do so, you must send a notice of appeal to the District Court within six weeks. This can only be done by mail. The District Court's address is:

A judge will then hear the case. If the judge does not find in your favor, you can appeal. This can be done at the Central Appeals Tribunal in Utrecht. It is also possible that the judge will find in your favor, but Fijnder does not agree with it. Then you can Fijnder also file an appeal.

Preliminary injunction

Can't wait until the objection or appeal procedure is complete? Then apply for an interim injunction from the court. With an interim injunction, you ask the judge to review the decision of Fijnder To interrupt. The judge will indicate whether or not you will be granted interim relief. Note: you must pay to apply for interim relief.
